August 2010 – The Baylor Law Review published Bob Wise’s Administrative Penalties Against Electricity Market Participants Under the Texas Public Utility Regulatory Act in its fall edition, Baylor Law Review, 62 Baylor L. Rev. 788 (2010).  The article, Wise’s eighth, provides a comprehensive discussion of the nature of, and procedures for, the imposition of administrative penalties by the Public Utility Commission of Texas against electricity-market participants.  Wise wrote the article after successfully representing electricity-market participants in the largest administrative-penalty proceeding in Texas history, Tex. Pub. Util. Comm’n, Notice of Violation by TXU Corp., et al., of PURA § 39.157(a) and PUC Subst. R. § 35.503(j), Docket No. 34061 (Mar. 28, 2007), and representing another participant in an administrative-penalty proceeding, Tex. Pub. Util. Comm’n, Agreed Notice of Violation and Settlement Agreement Relating to Luminant Energy Company LLC’s Violation Of PURA § 39.151(j) and PUC Subst. R. § 25.503(f)(2), Relating to Failure to Adhere to ERCOT Protocol § 6.10.5.4(1) Concerning Load Acting as Resource Service Requirements, Docket No. 37634 (Nov. 5, 2009).
