
August 13, 2013 – After oral argument, the U.S. Fifth Circuit Court of Appeals affirmed a take-nothing judgment obtained by LWS in federal court in the Northern District of Texas in Federal Trade Commission v. Financial Freedom Processing, Inc., et al., No. 12-10520, 2013 U.S. App. LEXIS 16766 (5th Cir. Aug. 12, 2013). In the action, the FTC sought more than $58 million dollars in restitution from three debt-settlement companies and four of their officer/directors for alleged deceptive advertising in violation of Section 5(a) of the FTC Act, 15 U.S.C. § 45(a). After the district court issued a defense verdict, the FTC appealed to the Fifth Circuit. Bob Wise, with the assistance of Katherine Hendler, represented the defendants on appeal and successfully preserved their trial victory.
