November 30, 2012 – After 45 depositions and over two years of litigation, LWS obtained summary judgment for its client, Oncor Electric Delivery Company LLC, on claims brought by numerous insurance companies and property owners, alleging that Oncor started the “1148 Complex Fire” which burned many homes, a resort under construction, and land on the West Side of Possum Kingdom Lake. The plaintiffs sought roughly $30 million in damages. Judge Lowy of the 101st District Court in Dallas County, Texas, struck plaintiffs’ experts after a Daubert hearing and granted summary judgment in favor of Oncor, effectively holding that there was no material evidence that Oncor started the fire. The plaintiffs have appealed. LWS’s Andy Szygenda served as lead counsel for Oncor and was assisted by his partner, Tom Lillard, and paralegal, Emily Diebitsch.
