March 13, 2012 – The Texas Lawyer (an ALM Publication) has named LWS attorney Bob Wise “Litigator of the Week” in an article entitled “Beating the FTC.” Bob was selected as the “Litigator of the Week” after leading a trial team that obtained a complete defense verdict against the Federal Trade Commission in Federal Trade Commission v. Financial Freedom Processing, Inc., et al., No. 3:10-CV-2446-N (N.D. Tex. Mar. 12, 2012). In that lawsuit, the FTC sued three debt-settlement companies and four of their officers/directors for alleged false and deceptive advertising in violation of Section 5(a) of the FTC Act, 15 U.S.C. § 45(a). The FTC sought more than $58 million dollars in restitution from the defendants. After a trial in the U.S. District Court for the Northern District of Texas, Hon. David Godbey found that the defendants did not violate the FTC Act and entered judgment in the defendants’ favor. A copy of the article is available by clicking the link above.
